ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.08.2016 in connection with N.H. Bangra P.S. Case No.62 of 2016, G.R. No.1690 of 2016, registered for the offence under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but on the basis of the confessional statement made before the police by a co-accused, a motorcycle was recovered and the name of the petitioner has thereafter been brought in connection with the present case. It is further submitted that no recovery was made from the possession of the present petitioner.

No.48135 of 2016 (2) dt.24-11-2016 2/2 In view of the fact that the name of the petitioner has come on the confessional statement made by a co-accused, which has no evidentiary value, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur, in connection with N.H. Bangra P.S. Case No.62 of 2016, G.R. No.1690 of 2016.
