On 04.07.2017, the matter was referred to the Patna High Court Mediation Centre where the petitioner and the complainant-opposite party no. 2 would be present for amicable settlement. The provisional bail was granted to the petitioner in the meantime. The matter has been settled by the mediator of the Patna High Court Mediation Centre by an agreement dated 10.11.2017. Both parties have settled the matter on terms that petitioner would keep his wife with full dignity and honour and the complainant would withdraw the present Complaint Case No.

Patna High Court Cr.Misc. No.28289 of 2017 (3) dt.15-11-2017 2/2 242(c) of 1996.

It has been submitted by the learned counsel for the opposite party no. 2 that the petitioner has taken his wife to the matrimonial house but is not keeping her properly. But learned counsel for the petitioner submits that as per the compromise his wife is being looked after with full dignity and honour. The matter is sent to the court of the learned Judicial Magistrate, 1st Class, Patna and both parties will appear before the learned Judicial Magistrate, 1st Class, Patna on 05.12.2017 and the bail bond of the petitioner will be confirmed by the learned court below in case of three eventualities:- (i) if the matrimonial harmony is substantially restored or (ii) if the complainant fails to appear before the learned court below or (iii) if the complainant deliberately gets reluctant to reconcile the issue.
