The petitioner is apprehending his arrest in connection with Rahui P.S. Case No.168 of 2015 for allegedly having committed the offence under Section 379 of the Indian Penal Code and Section 3 of the Prevention and Damage of Public Property Act.

Learned counsel for the petitioner submits that the entire occurrence is emanating from cutting of mango tree lying on the Gairmazarua Aam land.

Considering the facts and circumstances and the nature of allegations and also the fact that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a
