====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-10-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the opposite party No. 2.
2. The petitioner apprehends his arrest in connection with Muzaffarpur Complaint Case No. 285 of 2022 for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
3. Learned counsel appearing on behalf of the petitioner submits that the dispute between the parties has been settled through process of mediation. The terms of settlement mutually agreed upon by the parties and the same is kept at 'Flag-A'.
4. Learned counsel for the opposite party No. 2 does not
Patna High Court CR. MISC. No.42907 of 2024(4) dt.07-10-2024 2/2 dispute the aforesaid contention.
5. Having considered the fact that the dispute between the parties has already been resolved through mediation, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Muzaffarpur (East) in connection with Muzaffarpur Complaint Case No. 285 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. with further condition that petitioner shall abide by all the terms & conditions, mentioned in Memorandum of Agreement dated 22.08.2024 before the Mediation Centre, failing which, learned Court below shall be at liberty to cancel the bail-bond of the petitioner.
