====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 31-08-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Pirbahore P.S. Case No. 233 of 2018 registered for the offences punishable under Sections 420, 274, 275, 276, 467, 468 and 120B of the Indian Penal Code under Section 27 (C), 28, 28A, 27 (b) (ii) and 29 (d) of Drugs and Cosmetic Act, 2008.

Informant who is a police officer has stated in his written complaint that on secret information a team of local police reached there and conducted raid in Pharma shops including petitioner shops also which is namely M/s Patna Pharma House, Bihari Sao Lane, M/s Ray Medical Hall, Bihar

Patna High Court Cr.Misc. No.42062 of 2018(4) dt.31-08-2018 2/2 Sao Lane and M/s Abhay Distributors, New Uday Place for which huge quantity of counterfeit medicines have been recovered.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has got no criminal antecedent and he is in custody since 27.04.2018. It has been further submitted that similarly placed co-accused, namely, Sameer Sharma and Vikash Kumar has been granted bail by coordinate Bench of this Court in Cr. Misc. No. 46633 of 2018 and 52428 of 2018 vide order dated 10.08.2018 and 28.08.2018 respectively.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Pribahore P.S. Case No. 233 of 2018.
