JUSTICE SANJAY PRIYA ORAL ORDER 24-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Vijaypur P.S. Case No. 23 of 2018 instituted for the offence under Section 304(B) of the Indian Penal Code.
It is alleged in the written report that informant on getting information that his sister has been done to death in her sasural, he along with his brother and Pattidar went to the sasural of his sister and found the dead body of his sister lying on the cot. It is further alleged that sister of the informant was tortured by this petitioner and other accused persons for demand of dowry and ultimately they killed her for non-fulfillment of demand of dowry. Case diary has been received.
Post mortem report is available in the case diary
Patna High Court Cr.Misc. No.41801 of 2018 (3) dt.24-09-2018 2/2 wherein the Doctor has found cause of death due to Asphyxia as a result of strangulation.
The petitioner is husband of the deceased.
From post mortem report it appears that deceased died unnatural death.
Therefore, this Court is not inclined to grant bail to the petitioner at this stage.
Prayer for bail of the petitioner stands rejected. Petitioner is given liberty to renew his prayer for bail after six months if no substantive progress is made in the trial. The court below is directed to expedite the trial. (Sanjay Priya, J) S.Ali/- U T
