Patna High Court CWJC No.15521 of 2014 (3) dt.29-06-2015 2/2 29-06-2015 The petitioner is a resident of Village Manikpur in the District of Patna. He contends that respondent nos. 5 to 10 have encroached substantial extent of Government land in Khata No. 119 of Plot No.102 of the said village. He further contends that the said fact was brought to the notice of the respondent nos. 1 to 4, but no steps have been taken to remove the same. On account of the same, the public in general are suffering much. A detailed counter affidavit is filed on behalf of the Anchal Adhikari, Pandarak, the 4th respondent. He has admitted that some of the respondents have encroached the land and even furnished the extent. It is stated that proceedings under the Bihar Public Land Encroachment Act, 1956 have been initiated and Case No.13 of 2013-14 is pending.

Heard learned counsel for the petitioner and the learned counsel for the respondents.

The allegation of the petitioner that some extent of the public land has been encroached was found to be correct. On their part, the Government Officers have already initiated proceedings under the Act. The same need to be expedited. Therefore, we dispose of this writ petition directing the authorities before whom Case No.13 of 2013-14 is pending, to dispose of the same within a period of three months, after hearing the concerned parties.
