The petitioner seeks bail in Bela P.S. Case No. 14/2016, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

The informant alleged that one Hare Krishna Yadav @ Chhote came with his truck to load fodders (Murgidana) for transportation to Gaya, but the consignment did not reach its place. The truck was found abandoned. Immediately, thereafter the petitioner was arrested who confessed his guilt and disclosed the entire facts. On the disclosure made by the petitioner empty bags of Murgidana were recovered from the house of Hare Krishna Yadav @ Chhote the owner and driver of the truck.

No.54272 of 2016 (3) dt.27-02-2017 2/2 It is submitted that Hare Krishna Yadav @ Chhote owner and driver of the truck was granted bail vide order dated 13.12.2016 passed in Cr. Misc. 51297/2016. The case of the petitioner stands on the same footing. Petitioner is in jail since 06.09.2016.

Considering the facts aforesaid and the fact that similarly situated co-accused, from whose possession Murgidana was recovered, has already been granted bail by a co-ordinate bench of this court vide order dated 13.12.2016 passed in Cr. Misc. 51297/2016, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-cum-Sub Judge 12th, Muzaffarpur in connection with Bela (Muzaffarpur) P.S. Case No. 14/2016.
