JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2018 Heard the parties. The petitioner seeks regular bail in connection with Neemachandpura P. S. Case No. 18 of 2018, registered for the offence under Sections 302/34 of the Indian Penal Code. As per F.I.R., allegation against the petitioner and three other accused persons is of killing the brother of the informant with iron rod and knife due to previous enmity, causing his death. Submission of the learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and there is no eye witness to see the occurrence and the petitioner is in custody since 05.03.2018.
Heard learned A.P.P. as well as learned counsel for the informant opposes the prayer for bail that the accused persons
Patna High Court Cr.Misc. No.42211 of 2018 (4) dt.01-10-2018 2/2 indiscriminately assaulted the deceased with iron rod and knife and injuries were found on the person of the deceased and the prayer of bail of the similarly situated co-accused person Chandan Kumar @ Bhikhari has already been rejected by a Co-ordinate Bench of this Court vide order dated 17.07.2018, passed in Cr. Misc. No. 43016 of 2018.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.
With the aforesaid observation, this application is dismissed.
