The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354, 341, 323, 406, 420, 120(B), 504, 506/34 of the Indian Penal Code.

It is alleged against the petitioner that being Panchayat Secretary, he went along with other accused persons at the house of the informant who is Ward member of Ward No. 5 and President of Ward Implementation Committee and forced her to transfer

Patna High Court CR. MISC. No.50186 of 2021(5) dt.20-09-2022 2/3 the amount of Jal Nal Yojana to the account of the contractor. The informant transferred Rs. 12,00,000/- in the account of the contractor but the work has not been completed.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The amount has been transferred by the informant in the account of the contractor and being the President of the Ward Implementation Committee, the petitioner was to look after the work and complete the same under Jal Nal Yojana but the informant, with a fear that government may realize the amount from her, has lodged this false case just to save her own skin. Moreover, the entire work has already been completed. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.50186 of 2021(5) dt.20-09-2022 3/3 weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P.S. Case No. 683 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
