JUSTICE RAKESH KUMAR ORAL ORDER 08-01-2016 Heard Sri Mrigendra Kumar, learned counsel for the petitioner and Sri Manish Kumar, learned Govt. Pleader no.8. In the present writ petition, in sum and substance, the petitioner has made a prayer for directing the Respondents to regularise his service as Jeep Driver, whereas in the counter affidavit, a stand has been taken by the State that such appointment has to be made under the provisions of the Bihar Motor Drivers (Appointment and Service Conditions) Rules, 2005, which has been framed by the State Government in the year 2005. As per Rule, the appointment is to be made by the Bihar Staff Selection Commission.
In view of facts disclosed in the counter affidavit, the
Patna High Court CWJC No.10796 of 2011 (3) dt.08-01-2016 2/2 Court considers that no positive relief can be granted to the petitioner. The writ petition stands disposed of. (Rakesh Kumar, J) NKS/- U
