JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Raushanganj (Bank Bazar) P.S. Case No. 73 of 2016, registered under Sections 366(A) and 120B/34 of the Indian Penal Code. The accusation is of enticing away the sister of informant by Ujjawal Bhuyia, Arbind Bhuyea and Pankaj Kumar with intention to perform the marriage and this petitioner being sister of Pankaj Kumar help them by giving money. Learned counsel for the petitioner submits that there was love affair in between sister of informant and Pankaj Kumar, brother of this petitioner, and sister of informant moved from house according to her own sweet will and performed the marriage

Patna High Court Cr.Misc. No.29906 of 2017 (3) dt.14-07-2017 with Pankaj Kumar due to that reason petitioner has falsely been implicated in this case. Further submission is that petitioner is in custody since 01.03.2017.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sherghati (Gaya) in connection with Raushanganj (Bank Bazar) P.S. Case No. 73 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
