ANJANA MISHRA ORAL ORDER 23-08-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Bhargama P.S. Case No.279 of 2017 for allegedly having committed the offence under Sections 354A, 354D, 506, 509/34 of the Indian Penal Code and Sections 66, 67(A), 67(B) of the I.T. Act, 2000. Learned counsel for the petitioner submits that neither the petitioner is responsible for any offence under Sections 354A, 354D of the I.P.C. nor has he committed any offence under the relevant provisions of Sections 66, 67(A), 67(B) of the I.T. Act. It is further submitted that after a span of 11 months of the lodging of the F.I.R., the petitioner's name has been brought in that he "likes the photo" which

Considering the aforementioned facts and circumstances and the nature of allegation as against the present petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Bhargama P.S. Case No.279 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
