The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324 and 302/34 of the Indian Penal Code. It is alleged that the father-in-law of the informant was getting the filed ploughed then this petitioner resorted to fire on him but it accidentally hit the son of the petitioner who died subsequently.
It is submitted by learned counsel for the petitioner that there is a counter version of the occurrence also wherein there is specific case that the informant side shot at the son of the petitioner.
Patna High Court Cr.Misc. No.36053 of 2015 (2) dt.21-08-2015 2/2 This Court is not inclined to interfere only because the case was instituted in 2004.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bibhutipur P.S. Case No. 143 of 2004 pending in the court of learned Judicial Magistrate, Ist Class, Rosera (Samastipur).
With the aforesaid observation, this application is disposed of.
