The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, the accused-petitioner was taken into custody while the other accused managed to escape. From the Bolero, two motorcycles and the shed, a total of 945 litres of liquor was recovered.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case. No incriminating article has been recovered from his possession and he was caught under a misunderstanding. He has no concern either with the seized liquor nor with the vehicles in question or the place of recovery. He is in custody since

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner being in custody for more than 10 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Jamhor P.S. Case no.67 of 2021 (Sp. Case no.666 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Excise, Aurangabad.
