JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2018 The petitioner seeks regular bail in connection with Sakatpur P.S. Case No. 18 of 2018, registered for offences punishable under Sections 461 and 379 of Indian Penal Code. Allegation as per F.I.R. is of commission of theft of mobile sets of different companies, laptop and other articles from the electronic shop of the informant and petitioner is an accused in three other cases.

It has been submitted on behalf of the petitioner that he is not named in the F.I.R., his name has surfaced in this case only on the basis of confession of co-accused Dilip Thakur and on his disclosure, some articles were alleged to be recovered from coaccused Dilip Thakur and from the petitioner and except that there is nothing against the petitioner. Patna High Court Cr.Misc. No.46820 of 2018 (3) dt.20-09-2018 2/2 judicial Custody since 06.05.2018.

Heard learned A.P.P. also.

Having heard both sides, considering the fact and circumstances of the case and also the criminal antecedent of the petitioner, at this stage, I am not inclined to enlarge the petitioner on bail. However, once the charge is framed and the trial is commenced, the Trial Court shall release the petitioner on bail to his own satisfaction.
