2. The petitioner seeks regular bail in connection with Bahadurganj P.S. Case No. 245 of 2025 for the offences registered under Sections 30(a), 41(1), 47 of the Bihar Prohibition & Excise Act and Sections 281, 125, 109(1) of the B.N.S.
3. There is recovery of 378.260 litre Indian made foreign liquor from a Scorpio bearing Registration No. WB18D 9600. Petitioner was arrested on the spot and one co-accused, Dheeraj, fled away from there.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion. He had hired the seized
Patna High Court CR. MISC. No.43531 of 2025(4) dt.17-09-2025 2/2 Scorpio to go to his home town. He had no knowledge that the driver of the said vehicle had kept liquor in the seized vehicle. Petitioner has neither concern with the seized liquor nor with the Scorpio in question. Petitioner has clean antecedent. He is in judicial custody since 23.05.2025. Petitioner undertakes to cooperate in the trial.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court of Exclusive Special Judge Excise-I, Kishanganj in connection with Bahadurganj P.S.
