The petitioner apprehends his arrest in a case under Section 420 and other sections of the Indian Penal Code. The petitioner purchased a piece of land from one Suresh Tanti, son of Gaunu Tanti. Gaunu Tanti is the brother of Fakira Tanti as the same would appear from the Genealogical Table (Annexure-F, at page 75 of the supplementary affidavit), issued by the Circle Officer, Begusarai. It is submitted that the complainant wrongly alleged that Fakira Tanti had no brothers and the petitioner impersonated Suresh Tanti and got the sale deed executed.
Considering the fact that the petitioner got the sale deed registered from Suresh Tanti, who is shown as the son of Gaunu (brother of Fakira) in the Genealogical Table, issued under
Patna High Court Cr.Misc. No.51261 of 2014 (4) dt.30-06-2015 2/2 the signature of the Circle Officer, Begusarai, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.R. Raman, Judicial Magistrate, 1st Class, Begusari in Complaint Case No. 1691C of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
