2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 376 of the Indian Penal Code and Section 4 of the POCSO Act, registered in connection with Antichak P.S. Case No. 144 of 2023.

3. As per prosecution case, the petitioner is said to have committed rape upon the daughter of the informant in a mustard field.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.44283 of 2024(5) dt.01-10-2024 2/3 that he has been falsely implicated in this case and has committed no offence. The statement of the victim recorded under Section 164 of the Cr.P.C. in which she stated that when she raised alarm, the villagers gathered there and handed over the petitioner to the police whereas para-24 of the case diary shows that the petitioner was arrested from his house. He further submitted that in Medical examination, no sign of rape or assault was found upon the victim. Moreover, petitioner is a person of clean antecedent and he is in custody since 02.01.2024.

5. Learned APP for the State has opposed the prayer of bail but fairly admits the submission of learned counsel for the petitioner that in Medical examination, no sign of rape or assault was found upon the victim.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge POCSO-cum-7th Additional District and Sessions Judge, Bhagalpur in connection with Antichak P.S. Case No. 144 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when
