1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Hisua Police Station Case No. 17 of 2025, disclosing offences under Sections 329(4), 126(2), 115(2), 109, 74, 303(2), 352, 351(2), 351(3), 3(5) of the BNS, 2023.
3. As per the prosecution case on 12.01.2025, in the afternoon, when the informant along with her husband and grandfather-in-law was present in her home, petitioners along with others arrived there with lathi, hockey stick, etc., started abusing the informant's husband. It has further been alleged that the petitioners assaulted the husband of the informant by khanti

4. Learned counsel for the petitioners submits that both the parties are agnates and there is land dispute between them. A counter case has been lodged by the side of the petitioners against the informant and others bearing Hisua P.S. Case No. 19 of 2025. The injury sustained by the victim is simple in nature.
5. On the other hand, learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that there is specific allegation of assault against the petitioners. The CT scan of the victim was conducted. The side of the petitioners sold their share of land and are having eyes on the land of the informant's side.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates, there is case and counter case between them, land dispute is also there and the injury sustained by the victim is simple in nature, I am inclined to grant the petitioners privilege of anticipatory bail.
7. This application is, accordingly, allowed.
8. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four

No.40276 of 2025(2) dt.16-07-2025 3/3 weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Hisua Police Station Case No. 17 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
9. However, it is made clear that if similar offence is committed by the petitioners in the future, their bail bonds shall be liable to be cancelled.
