The petitioner, who is in custody, seeks bail in connection with Bheldi P.S. Case No. 09 of 2009 registered for the offences punishable under Section 392 of the Indian Penal Code and later on Sections 395 and 412 of the Indian Penal Code were added.
Allegation against petitioner is of assaulting of the informant and his cousin brother-in-law by belt, fists and slaps and snatching of Rs.500/-, motorcycle and other documents from the informant.
It has been submitted on behalf of the petitioner that petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. It has been further
Patna High Court Cr.Misc. No.49197 of 2018(3) dt.27-09-2018 2/2 submitted that name of petitioner has surfaced in this case only on the basis of confessional statement of one suspected caught co-accused person namely, Jitendera Rai who has been granted bail by a co-ordinate Bench of this Court passed in Cr. Misc. No. 1870 of 2010 vide order dated 01.02.2010. Petitioner is remanded in the present case on 16.05.2018 and since then he is in custody.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- XIIth, Saran at Chapra, in connection with Bheldi P.S. Case No. 09 of 2009.
