Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code.
As per the prosecution case, six FIR named accused persons, including this petitioner, assaulted with Lathi etc. to the son of the informant as a result whereof he died. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that there is allegation that all the accused persons assaulted the son of informant but the doctor has found only two injuries on the person of injured, one was abrasion on the right temple and another was bruise at the right eyebrow. Patna High Court CR. MISC. No.50656 of 2021(2) dt.29-11-2021 2/2 situated accused Md. Salamat Sah has already been granted bail by a co-ordinate Bench of this court vide order dated 24.04.2019 passed in Cr. Misc. No. 7585/2019. Petitioner claims clean antecedent and is in custody since 10.02.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VIII, Muzaffarpur in connection with Paroo PS case No.226/2018.
