This application is for grant of regular bail in connection with Ander P.S.Case No.144 of 2016for the offences under Section 379 of the Indian Penal Code.
Allegation against the petitioner as per FIR is of theft of the motorcycle and the FIR is against unknown person and later on name of the petitioner transpired during the course of investigation on his own confession. The petitioner is accused 10 other cases also.
Submission of the learned counsel for the petitioner is that there is no recovery from the petitioner and in three other cases he has already been acquitted and he is in custody since 28.12.2016.
Patna High Court Cr.Misc. No.46667 of 2018 (4) dt.19-09-2018 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, as trial is going on, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conduct it on regular basis so that it maybe concluded within a reasonable time. With the aforesaid observation, this application is dismissed.
