2 The petitioner has preferred this application for grant of regular bail in connection with Patori PS Case No 224 of 2023 dated 25.03.2023 registered for the offence punishable under Sections 399, 402, 414 of the IPC and Sections 25 (1-B), 26, 35 of the Arms Act.

3 As per the prosecution case, one loaded pistol and a mobile phone were recovered from the possession of the petitioner.

4 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has one criminal antecedent, as stated in

Patna High Court CR. MISC. No.42961 of 2023(2) dt.20-07-2023 2/2 paragraph 3 of the bail petition in which he is on bail. The petitioner is in custody in this case since 26.03.2023. 5 Learned APP has vehemently opposed the bail petition of the petitioner.

6 Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of JM, 01st Class, Samastipur in Patori PS Case No 224 of 2023 dated 25.03.2023. 7 This application stands allowed.
