The petitioner is accused in connection with Special (POSCO) Case No. 48 of 2016 registered under Sections 377, 506 of the Indian Penal Code and Section 4 of POSCO Act pending in the Court of 1st Additional Sessions Judge, Patna. It is alleged that the petitioner has committed unnatural offence with the son of the informant.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that the victim in his statement under Section 164 Cr.P.C has clearly stated that the petitioner has committed unnatural offence with him. Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.51597 of 2016 (6) dt.20-02-2017 case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Prakash/- U
