The petitioners apprehend their arrest in Belhar P.S. case No. 290 of 2016 under Section 307, 325 and other Sections of the Indian Penal Code.
The informant alleged that on 30.08.2016 she-goat of Nand Kishore Singh and Subhash Singh came in the field of informant and damaged the crops and when the informant protested Subhash Singh assaulted the informant with Khanti on his head. Nand Kishore Singh, petitioner No.2, is alleged to have assaulted the mother of informant. Petitioner No.1, Shree Lal Singh, is alleged to have assaulted the sister of the informant. The learned counsel for the petitioners submits that
Patna High Court Cr.Misc. No.28566 of 2017 (4) dt.22-08-2017 2/2 petitioners are co-sharers. Some scuffle took place. The injuries found on the mother and sister of the informant are simple in nature. Subhash Singh has already been granted bail, who is alleged to have assaulted Arbind Singh, the informant of the case, and Arbind Singh got grievous injuries.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Belhar P.S. case No.290 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
