JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 120B, 409, 420, 467, 468 and 477A of the Indian Penal Code, 13(2) read with 13(1)(c) and (d) of the Prevention of Corruption Act.

The prosecution case of receiving several complaints in respect of irregularity in payment of old age pension and MANREGA in the district of Araria through the various post office when `1,14,25,807/- were misappropriated. The petitioner was posted as Village Post Master at Gidhwas branch, post office. It is submitted by learned counsel for the petitioner that the accusation against the petitioner is omnibus and general and other similarly situated accused persons have been granted

Patna High Court Cr.Misc. No.35498 of 2015 (4) dt.24-09-2015 2/2 anticipatory bail vide Cr. Misc. Nos. 25429 of 2014, 23157 of 2014 and 26006 of 2014. Moreover, no evidence has been collected during investigation that any withdrawal was made from the petitioner's post office.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, C.B.I.-II, Patna in connection with Special Case No. 01 of 2013 arising out of R.C. Case No. 02 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
