Petitioner seeks bail in a case registered for the offences punishable under Sections 8/20(b)(ii)(c) of N.D.P.S. Act and Section 147 of Railway Act.

The petitioner is in custody since 18.10.2017 on allegation that 10 Kg of Ganja was recovered from possession of the petitioner at the railway station. Earlier, prayer was refused vide Annexure-1 on 11.04.2018 with a direction to the learned Trial Judge to expedite the trial.

The report of the learned Trial Judge dated 03.08.2018 would reveal that even police papers have not been supplied to the accused.

Considering the aforesaid facts, let the

Patna High Court Cr.Misc. No.41570 of 2018 (3) dt.29-08-2018 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No.157 of 2017 arising out of Rail Danapur Police Station Case No.106 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
