JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 06-01-2022 Heard both the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Halsi P.S. Case No.185 of 2020 instituted for the offences under Section 30(a) of Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is the owner of the truck, which was found at the house of one Deepak Kumar Singh being loaded with liquor. The pick up owned by the petitioner has never been earlier involved nor the petitioner has any criminal background. I have considered the submission.

Taking into consideration that the petitioner was not present at the site nor he can be said to be having knowledge of

No.50309 of 2021(2) dt.06-01-2022 2/2 the loading of the liquor in his pick up van, which was being driven by the driver and prima facie no case under Section 30(a) of the Excise Act is made out as against the petitioner, I am inclined to grant anticipatory bail to the petitioner and in the event of arrest, he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
