The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
Petitioner is a government servant and was working as Panchayat Secretary at the relevant time. The petitioner, allegedly, did not submit the service folder of the teachers appointed on contract to the superior authorities. Submission is that it may be a case of negligence or insubordination of a government servant. However, no criminal liability is made out.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the
Patna High Court Cr.Misc. No.51984 of 2016 (2) dt.20-12-2016 2/2 Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua/Successor Court in connection with Chainpur Police Station Case No. 149 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
