JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the first information report but from perusal of the impugned order it would appear that name of petitioner came in confessional statement of co-accused and except the aforesaid confessional statement, there appears to be nothing against the petitioner, who is languishing in jail custody since 03.05.2016. Moreover, co-accused, Priyesh Kumar @ Badka has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 17.03.2016 passed in Cr. Misc. No. 783 of 2016.
