Case No.128 of 2009 wherein offences punishable under Sections 406, 409, 420, 467, 468 and 34 of the Indian Penal Code were alleged. Several others were also figured as accused. Apprehending his arrest, the petitioner filed ABA no.952 of 2013 in the Court of Sessions Judge, Begusarai. The same was rejected on 13.02.2014. Hence, this application under Section 438 Cr. P.C.
Heard learned counsel for the petitioner and learned A.P.P. for the State.
The allegation against the petitioner and other accused is that they have embezzled the cash in the chest of the office. The record discloses that other accused such as Ajay Kumar Verma and Congress Choudhary were granted
Patna High Court Cr.Misc. No.28144 of 2014 (5) dt.02-07-2015 2/2 anticipatory bail by this court on condition that they shall surrender before the Court within four weeks together the copy of the order passed by this court.
Following the same, this application is also ordered directing that in case, the petitioner surrenders before the trial Court within four weeks from today together with the copy of this order, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P. S. Case No.128 of 2009, subject to the conditions as laid down under Section 438(2) Cr. P.C.
