Soni Shrivastava, learned counsel for the petitioner and Sri Surendra Kumar, learned A.P.P. for the State. The petitioner is seeking regular bail in connection with Govindpur P.S. Case No. 24 of 2017 for offence registered under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that a bare perusal of the First Information Report shows that alleged recovery has been made from the Scorpio vehicle, which has been seized by the patrolling party, however, this petitioner has nothing to do with the said Scorpio. A Supplementary Affidavit has been filed stating therein that the co-accused Pappu Kumar @ Sanjeev Ranjan had been granted regular bail by a co-ordinate Bench of this Court. Learned A.P.P. opposed the prayer for bail.

Considering the facts and circumstances of the case that there is no criminal antecedent of the petitioner and he is in custody

No.25691 of 2017 (2) dt.14-06-2017 2/2 since 16.03.2017 as also that the co-ordinate Bench granted regular bail to the petitioner, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Nawada in connection with Govindpur P.S. Case No. 24 of 2017, subject to the condition under Section 437 (3) Cr.P.C. (Rajeev Ranjan Prasad, J) manish/- U T
