The petitioner is accused in connection with Neemchak Bathani P.S. Case No. 106 of 2013 registered under sections 302, 328 and 34 of the I.P.C. pending in the Court of Additional Chief Judicial Magistrate-X, Gaya. Learned counsel appearing on behalf of the petitioner submits that petitioner, who happens to be the husband of the deceased, has falsely been implicated in this case. It is also submitted that petitioner is in custody since 27.07.2016. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is direct allegation against the petitioner to kill the daughter of the
Patna High Court Cr.Misc. No.17529 of 2017 (4) dt.20-06-2017 2/2 informant by administering poisonous substance in conspiracy with the co-accused persons and the witnesses have also supported the prosecution version.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, trial Court is directed to conclude the trial within a period of six months.
