JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2018 Earlier prayer for bail of the petitioner was rejected by a co-ordinate Bench of this Court vide order dated 14.5.2013 passed in Cr.Misc.No. 15634 of 2012. However, twice petitioner has misused the privilege of bail and now he is in custody since 28.12.2015.

Submission of learned counsel for the petitioner is that the case is pending for argument but as the record has been sent to this Court in Cr.Appeal (DB) No. 618 of 2014 the argument could not be concluded.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. However, Registry is directed to send the lower court

Patna High Court Cr.Misc. No.45290 of 2018 (3) dt.08-08-2018 2/2 records to the court below within a period of four weeks, so that argument may be concluded there. At the same time, learned court below is directed to send back the records to this Court as and when argument is concluded.
