In this case, the petitioners are seeking regular bail in connection with Turkauliya P.S. Case No.771 of 2015, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 120(B) of the Indian Penal Code and under section 27 of the Arms Act.

The cause of incident was land dispute. There is case and counter case from both the sides. Specific allegation has been made against four persons namely Sheih Safi, Sheikh

No.39454 of 2016 (2) dt.17-09-2016 2/2 Matiur Rahman, Sadre Alam and Sheikh Wali Ahamed, who were not holding any sharp cutting weapon, rather they were holding Lathi, but the medical report shows that the injury caused to the deceased is possible with sharp cutting weapons. Looking to the nature of allegation and also the fact that there is no specific allegation made against the present petitioners, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10, 000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihar (East Champaran), in connection with Turkauliya P.S. Case No.771 of 2015. (Shivaji Pandey, J) pawan/- U T
