JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 489A, 489B, 489C of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was twice rejected by this court but the impugned order goes to show that up till now, five prosecution witnesses have already been examined and the trial of the petitioner is going in full swing. Considering the aforesaid facts and circumstances as well as allegation levelled against the petitioner, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 657 of 2015 arising out of

Patna High Court Cr.Misc. No.25867 of 2017 (3) dt.12-07-2017 2/2 Ramgarhwa P.S. Case No. 191 of 2014 pending in the court of 9th Additional Sessions Judge, East Champaran stands rejected. However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible even by taking the trial of the petitioner on day to day basis as the petitioner is in jail custody for more than two years.
