JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and subsequently, Section 302 of the Indian Penal Code was added.
Petitioner is said to have assaulted the injured, Rajendra Singh and so far as deceased is concerned, it is alleged that he was assaulted by one Sanjeev though general allegation of assault to the deceased has been levelled against all the F.I.R. named accused. After the occurrence deceased was examined by the doctor, who found whole body pain and tendency of vomiting. Thereafter, deceased was admitted but it is alleged that he died in course of his treatment on 07.07.2016 i.e. near about after two
Patna High Court Cr.Misc. No.46518 of 2016 (2) dt.24-10-2016 2/2 months of the alleged occurrence. The present occurrence appears to have taken place on account of land dispute and both parties have filed cases against each others. Co-accused, Krishna Singh has already been granted privilege of bail by a co-ordinate Bench of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Manoj Kumar, Judicial Magistrate 1st Class, Siwan in connection with Goreya Kothi P.S. Case No. 50 of 2016.
