The petitioner seeks bail in Sahebganj P.S. Case No. 369/2018, instituted for offence under Section(s) 364A of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. F.I.R. has been lodged against unknown.

It is alleged in the written report that on the date of occurrence son of informant, namely, Vikky Kumar, aged about 11 year old, who was student of Class 5th, was kidnapped by two accused persons. It is alleged that in the evening informant received call on his mobile for demand of Rs. 20 lacs as ransom. Victim boy on recovery has given statement under Section 164 Cr.P.C., wherein he has stated that he was brought to different places by the accused persons. He knew the name of accused persons from their talk, as Ujjawal and Sundaram (Petitioner). The victim boy has not levelled specific allegation against this petitioner that demand of ransom was made by him. The other co-accused has already been granted bail by a Co-ordinate Bench of this Court vide order dated 12.06.2019 passed in Cr. Misc. No. 22816/2019.

Petitioner is in custody since 09.10.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, West Muzaffarpur, in connection with Sahebganj P.S. Case No. 369/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
