This is an application for bail in connection with Madhepura P.S.Case No. 598 of 2016 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that there is no specific allegation of assault against the petitioner and only allegation is that he caught hold of the informant, who has been stabbed by other co-accused and the petitioner is in custody for two months.

Heard learned APP also.

Having heard both sides and considering the fact that there is direct allegation against the petitioner that he caught hold of the informant and thereafter co-accused has stabbed him, I am

Patna High Court Cr.Misc. No.54735 of 2016 (3) dt.28-01-2017 2/2 not inclined to grant bail to the petitioner. Accordingly, prayer for bail is rejected.

However, the petitioner may renew his prayer for bail after framing of charge in this case.
