2. The petitioner has preferred this application for grant of regular bail in connection with Begusarai Cyber P.S. Case No. 12/2024 dated 13.04.2024 registered for the offence punishable u/ss 467, 468, 471, 419 and 420 read with 34 of the Indian Penal Code and Section 66D of the I.T. Act.
3. As per the prosecution case, the co-accused, namely, Prince Kumar assured the informant that he would employ him in Horlicks company and for this the petitioner took Aadhar card, PAN card, photo and finger print of the informant several times. Thereafter, the accused person opened account no. 5149297038 in Mahindra Bank and another account no.
Patna High Court CR. MISC. No.49485 of 2024(3) dt.22-08-2024 2/3 501023587881 as NSDL in the name of the informant. The accused person started operating the account of the informant and took ATM Card of the informant and started withdrawing money through these accounts. It is further alleged that the petitioner, namely, Rajam Kumar was also involved in this and he used to operate the aforesaid accounts for money transactions.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Learned counsel has submitted that the petitioner is neither involved in cyber crime nor he had opened a bank account of any person. Similarly situated co-accused has already been granted bail by the co-ordinate bench of this court vide order dated 20.06.2024 passed in Cr. Misc. No. 41695 of 2024. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.04.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond
Patna High Court CR. MISC. No.49485 of 2024(3) dt.22-08-2024 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Begusarai Cyber P.S. Case No. 12/2024.
7. The application stands allowed.
