The petitioner apprehends his arrest in connection with Ganga Bridge P.S. Case No. 26 of 2021 registered for the offence under Sections 414, 467, 468, 471 of the Indian Penal Code and Sections 30 (a), 36, 41 of the Bihar Prohibition and Excise Amendment Act.

Learned counsel for the petitioner submits that the tempo does not belong to the petitioner and he is being sought to be arrested. Learned counsel further submits that case under Section 30 (a) is thus not made out against the petitioner. Considering the fact, taking into consideration that the petitioner was neither present at the place of recovery and nor the tempo belongs to him, I am inclined to grant benefit of
