2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, all the F.I.R. named accused persons, including this petitioner, in connivance, with each other committed murder of grandfather of informant. It is alleged that co-accused Anand Kumar gave country made pistol to Guddu Kumar and told him to kill informant and his grandfather and thereafter, co-accused Guddu Rai fired below the neck of grandfather of informant as a result of which he died.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. From bare perusal of the FIR. it is apparent that specific accusation of committing murder of grandfather of informant is against co-accused Guddu Rai. There are general and omnibus allegations against this petitioner. Petitioner is in custody since 02.02.2025 having clean antecedent.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the general and omnibus nature of accusation, the prayer for bail of the petitioner is allowed.

7. Let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Koilwar P.S. Case No. 734 of 2023.
