06-07-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
One Chandan Kumar was apprehended by the police of Sheohar P.S. who during course of interrogation confessed and further disclosed that Rajnish Kumar is also engaged in sale of wine whereupon, grocery shop of Rajnish Kumar Singh was searched wherefrom twenty-four pieces of Royal Stag Whisky, each containing 750 ml were seized. Petitioner is not named in the written report but from the order impugned, it is evident that name of petitioner transpired on account of inculpatory extra judicial confessional statement of Rajnish Kumar Singh as well as Madhurendra Kumar @ Chunnu Singh without any recovery. It has also been submitted that after apprehension, petitioner has also been made an accused in connection with Sheohar P.S. Case No.58/2017.
Patna High Court Cr.Misc. No.28547 of 2017 (2) dt.06-07-2017 Accordingly, petitioner Ashok Giri is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge cum Special Judge, Excise, Sheohar in connection with Bhataha P.S. Case No.33/2017.
