Versus
1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Prem Ranjan Kumar For the Opposite Party/s : Smt. Indu Bala Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-08-2017 The petitioner seeks regular bail in connection with Salimpur P.S. Case No. 52 of 2017, registered for offences punishable under Sections 304B, 120(B) and 34 of Indian Penal Code.
Allegation against the petitioner, who is husband of the deceased is of causing dowry death of the deceased. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and as a matter of fact the case has not been lodged by the informant rather the same has been lodged by the chowkidar of the village. Further he has been in judicial custody since 18.04.2017.
Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and
Patna High Court Cr.Misc. No.34905 of 2017 (2) dt.04-08-2017 circumstances of the case and also considering the fact that father of the deceased has also alleged about demand of dowry and torture to the deceased by the petitioner, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it within a period of one year. (Vinod Kumar Sinha, J) sunil/- U T
