Petitioner is apprehending his arrest in connection with Muffasil P.S.Case No.276 of 2018 , registered for offences punishable under Sections 341, 342, 323, 324, 307, 354(B), 379, 498(A) and 506 of the Indian Penal Code.

As per the report, allegation is that petitioner, happens to be Dewar of the informant, and his other family members were assaulting her so the informant committed suicide . It is also said that the family members of the informant came on that the petitioner came with Farsa and assaulted the brother of the informant by Farsa causing injury to him. It is also alleged that all the family members have assaulted and some of them tried to outrage her modesty.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted. He is residing

Patna High Court CR. MISC. No.37995 of 2019(3) dt.20-09-2019 2/2 separately and falsity of the case will appear from the fact that the whole family members have been made accused in this case. He is ready to abide by any condition imposed upon him if he is granted anticipatory bail.

Heard learned A.P.P. ,w ho has opposed the prayer for bail on the ground that the injury is there on the body of the brother of the informant. .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM,, Motihari in connection with Muffasil P.S.Case No.276 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
