Petitioner seeks bail in a case registered under Sections 272, 273 of Indian Penal Code and Section 30 (a), 54 of Bihar Prohibition and Excised Act, 2016.

Learned counsel for the petitioner submits that from perusal of the first information report, it would be apparent that the seized articles, which have been attributed to the petitioner, were recovered from a gunny bag which had been thrown away. Petitioner denies possession of the said articles and submits that he was going to his village from Rajpur and while he was passing through Tendu Bahar Road, he was arrested by the police and the thrown away gunny bag was attributed to him. He is in jail since

In the light of the aforesaid submissions, petitioner is directed to be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II - cum- Special Judge, Rohtas (Sasaram) in Nasriganj (Rajpur) Police Station Case No 108 of 2017.
