This is an application for bail in connection with Motipur P.S.Case No. 37 of 2017 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
Petitioner is not named in the FIR and later on in course of investigation he along with other co-accused has been named and there is allegation of demand of dowry and deceased was killed along with her child and thrown in the river. It has been submitted on behalf of the petitioner that except confessional statement there is nothing against the petitioner and he was not even present at the time of occurrence as he was appearing in ITI examination at Chennai but he has been
Patna High Court Cr.Misc. No.30190 of 2017 (3) dt.21-07-2017 2/2 made accused in this case and his family members also. Heard learned APP also.
Having heard both sides and considering the nature of offence, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail after framing of charge in this case.
With the above observation, this application is dismissed.
