The petitioner seeks bail in anticipation of his arrest in connection with Hajipur P.S. Case No. 661 of 2020 instituted for the offences under Sections 413, 414, and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is sought to be arrested in a case under Sections 413, 414, and 34 of the Indian Penal Code wherein motorcycle has been recovered from the house which jointly belongs to the petitioner and others. One of the cousin brother has already been arrested in the case. Taking into consideration the nature of allegation, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
