The petitioner is apprehending his arrest in connection with Budhuchak P.S. Case No.20 of 2014 for allegedly having committed the offences under Sections 354B and 504/34 of the Indian Penal Code and Section 3⁄4 of the POCSO Act, 2012.
Learned counsel for the petitioner submits that the allegation against the petitioner is omnibus in nature and, in fact, the girl was having love affairs with one Gopi Yadav and as the petitioner was his classmate, his name was included in the present F.I.R.
Considering the nature of allegation against the
Patna High Court Cr.Misc. No.46135 of 2014 (5) dt.02-09-2015 2/2 petitioner and also that he has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Budhuchak P.S. Case No.20 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
